Amendments Dated 09/19/2018 and In Relation to the Regulation Regarding the Application of Turkish Citizenship Law
The procedure to acquire Turkish citizenship according to Article 12 of the Turkish Citizenship Law numbered 5901 has been altered as purchasing one (or more real estates) worth at least USD 250,000.00 (two hundred fifty thousand American Dollars), or it’s equivalent in other currencies, by affixing an addendum to the relevant title deed by indicating that the real estate in question shall not be subjected to any sale transaction for three years initiates as of the purchase date of real estate.
Pursuant to the amendment indicated hereinabove, the procedure shall commence through purchasing any sort of real estate in the presence of the General Directorate of Land Registry and Cadastre. In order for a foreigner to benefit from this amendment, the terms enumerated below shall be fulfilled:
- There should be no legal obstacle, stemming from nationality, for relevant individual to purchase real estate in Turkey (it will be checked prior to engage any purchase transaction),
- In line with the Law numbered 2565, the real estate in question should not be located in territories forbidden to foreigners for purchase (in order to clarify as to whether prospective real estate located in forbidden territory or not, there should be a correspondence between the Military Services and General Directorate of Land Registry. Please bear in mind that this correspondence may last roughly two months)
- Total value of real estate (can be one or more) shall be at least USD 250,000.00 or it’s equivalent in other currencies.
- Prior or at the time of purchasing in presence of the General Directorate of Land Registry and Cadastre, purchasing party/foreigner should explicitly indicate that this real estate is purchased in order to obtain Turkish citizenship. In the meantime, it is also mandatory to affix an addendum over the purchased real estate.
- Real estate valuation report should be procured one of the institutions indicated by Bank Regulation and Supervision Agency (if there is a discrepancy between the sales price agreed between parties of sale transaction and amount determined by the competent valuation authority, the lower price shall be considered while determining whether USD is 250,000.00 is reached or not).
- The purchase transaction should be completed after 19/09/2018.
Even the requirements to acquire Turkish Citizenship by following exceptional procedure, as indicated hereinabove, have been fulfilled, it is necessary for foreigner to also provide standard documents requested by in line with the relevant law and regulations.
The application will be reported to the Ministry of the Interior by the General Directorate of Land Registry and Cadastre after the completion of purchase transaction. Please note that the Ministry of Interior shall conduct an ultimate assessment and provide citizenship provided that all of the aforesaid conditions are fulfilled.
